Transparantie
Openheid en transparantie zijn sinds haar oprichting in 2002 al kernwaarden van EFSA. Als overheidsinstantie moet EFSA rekenschap afleggen aan haar beoogde doelgroep, de burgers van de Europese Unie. Zonder hun vertrouwen kan de Autoriteit niet effectief functioneren.
Een nieuwe verordening betreffende de transparantie en duurzaamheid van de EU-risicobeoordeling in de voedselketen is sinds 27 maart 2021 van toepassing. Hierdoor kan de Autoriteit met inachtneming van de hoogste transparantienormen risico’s beoordelen.
Tijdens de uitvoeringsfase van de verordening heeft EFSA via een speciaal klankbord en enkele technische groepen nauw met belanghebbenden samengewerkt. Meer informatie kunt u hier vinden.
EFSA streeft er ook naar dat exploitanten van bedrijven en aanvragers alle informatie en ondersteuning krijgen die zij voor een soepele overgang naar de nieuwe omgeving nodig hebben. Hiertoe is een speciale pagina samengesteld die regelmatig wordt bijgewerkt, met adviezen, ondersteunend materiaal, details over opleidingsmogelijkheden en nog veel meer. De verordening heeft tot doel de risicobeoordeling in de voedselketen transparanter te maken, de betrouwbaarheid, objectiviteit en onafhankelijkheid van de bij EFSA ingediende studies te vergroten en het bestuur van EFSA te versterken om haar voor de lange termijn een duurzaam karakter te geven. Met name wordt daarin het volgende bepaald:
- Burgers krijgen toegang tot studies en informatie die bedrijven voor de risicobeoordeling indienen. Belanghebbenden en het publiek worden eveneens over deze studies geraadpleegd.
- EFSA wordt van alle bestelde studies op de hoogte gebracht om te waarborgen dat bedrijven die een vergunning aanvragen, alle relevante informatie indienen. De Autoriteit verstrekt de aanvragers ook advies voordat zij hun dossiers indienen.
- De Europese Commissie kan EFSA vragen aanvullende studies te bestellen en onderzoeksmissies ondernemen om na te gaan of laboratoria of studies aan de kwaliteitsnormen voldoen.

Public access to documents
Article 15 of the Treaty on the Functioning of the European Union (“TFEU”) sets the principle of transparency which includes the right of any citizen of the Union, and any natural or legal person residing or having its registered office in a Member State a right of access to documents of the EU institutions, bodies, offices and agencies according to the principles and conditions as defined in Regulation (EC) No 1049/2001. This right of access is also enshrined in Article 42 of the Charter of Fundamental rights of the European Union.
In order to give the fullest possible effect to the right of public access to documents, Regulation (EC) No 1049/2001 was adopted to implement the principle of transparency by setting up the procedure for addressing applications for access to documents. This Regulation also lists the exceptions to disclosure for protecting certain public and private interests. Regulation (EC) No 1049/2001 applies to EFSA as per Article 41 of Regulation (EC) No 178/2002. In addition, EFSA has adopted practical arrangements implementing Regulation (EC) No 1049/2001 and Articles 6 and 7 of Regulation (EC) No 1367/2006 and an internal operating procedure for handling applications for access to documents. Moreover, EFSA has adopted a Guidance for applicants to inform the public of their rights under Regulation (EC) No 1049/2001.
The right of public access to documents held by the EU institutions, bodies, offices and agencies embodies the principles of openness and transparency which constitute core values in the European legal order, contributing to a more transparent functioning of the European Union in a democratic system.
